These terms govern your use of the pxf apps (pxf, pxfSend, pxfClone) and the pxfCloud service, operated by Frank Capria (“we,” “us”). By using the apps or the service, you accept these terms.
The apps
The apps are licensed to you through the Mac App Store under Apple’s Standard License Agreement. Purchases and subscriptions are billed by Apple and governed by Apple’s terms. We do not process payments and cannot issue refunds; refund requests go to Apple.
The pxfCloud service
pxfSend’s delivery feature uploads your files to our servers and makes them available to recipients you name, through links sent by email.
Your account. You sign in with your Apple ID. You are responsible for activity under your account. You may delete your account at any time in the app; deletion removes your account record and all stored files.
Storage and retention. Your subscription tier sets your storage limit. Every delivery expires 30 days after upload, and its files are then permanently deleted. We are not a backup service. Keep your own copies; we are not responsible for files removed at expiration, at account deletion, or at subscription lapse.
Subscriptions. An active subscription is required to send. Subscriptions renew monthly through Apple until canceled in your Apple account settings. If your subscription lapses or is downgraded below your stored usage, existing deliveries remain available until they expire, but new deliveries are blocked.
Acceptable use
You may not use the service to store or distribute content that is unlawful, that infringes copyright or other rights, that contains malware, or that you lack the right to share. You may not use the service to harass, deceive, or spam recipients, or attempt to probe, overload, or disrupt the service. We may suspend or terminate accounts that violate these terms and remove content that we reasonably believe violates them.
Your content
You keep all rights to files you upload. You grant us only the license needed to store your files and deliver them to your named recipients. We do not read, analyze, or use your content for any other purpose.
Copyright complaints
To report infringing content, email support@pxftools.com with the delivery link, a description of the copyrighted work, your contact information, and a statement that you believe in good faith the use is unauthorized. We respond to valid notices by removing the identified content.
Disclaimers
The apps and the service are provided “as is,” without warranty of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data, arising from your use of the apps or the service. Our total liability for any claim is limited to the amount you paid us through Apple in the twelve months before the claim.
Changes
We may update these terms. Material changes will be posted on this page with a new effective date. Continued use after a change means you accept the updated terms.
Termination
You may stop using the apps and delete your account at any time. We may suspend or terminate service for violation of these terms or to comply with law.
Governing law
These terms are governed by the laws of the State of Massachusetts, without regard to conflict of law rules.
